Terms & Conditions

These Terms & Conditions ("Terms") govern your use of calmcoverentals.com (the "Site"), operated by Calm Cove Hospitality LLC, doing business as Calm Cove Rentals ("Calm Cove," "we," "us," or "our"). By using the Site, you agree to these Terms.

1. Bookings Through the Site

  • You must be at least 18 years old to make a reservation.
  • You agree to provide accurate and complete information when booking.
  • Rates, availability, and property details shown on the Site are subject to confirmation. A reservation is confirmed only when you receive written confirmation and payment has been processed.
  • Reservations made through third-party platforms (Airbnb, Vrbo, Expedia, Booking.com) are also subject to that platform's terms.

2. Accuracy of Site Content

We strive to keep listings, photos, rates, and availability accurate, but we do not guarantee the Site is error-free. We reserve the right to correct errors, including pricing errors, before or after a booking is confirmed; if we cancel a booking due to an error, we will issue a full refund.

3. Intellectual Property

All Site content — text, photographs, logos, and design — is owned by or licensed to us. You may not copy, reproduce, or use it for commercial purposes without our written permission.

4. Acceptable Use

You may use the Site only for lawful purposes related to browsing and booking our properties. You may not interfere with the Site's operation, attempt unauthorized access, scrape content, or submit false information.

5. Guest Reviews and Submitted Content

If you submit a review, photo, or other content to us or through a booking platform ("Submissions"), you grant us a non-exclusive, perpetual, royalty-free, worldwide license to use, reproduce, display, and publish those Submissions on the Site and in our marketing, along with the name you provide. You represent that you own your Submissions and that they are accurate and lawful. We may decline to publish, or may remove or edit, any Submission at our discretion, and we are not responsible for the content of user Submissions.

6. Privacy

Our collection and use of personal information is described in our Privacy Policy.

7. Text Messaging

If you provide your mobile number, we may send you text messages related to your reservation, such as booking confirmations, check-in instructions, and door codes, and — only with your consent — occasional marketing messages. Message frequency varies; message and data rates may apply. Reply STOP to opt out of marketing texts at any time or HELP for assistance. Opting out of marketing texts does not affect reservation-related messages.

8. Third-Party Links

The Site links to third-party sites and services, including booking platforms and social media. We are not responsible for their content or practices.

9. Disclaimer and Limitation of Liability

The Site is provided "as is" without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or exemplary damages arising from your use of, or inability to use, the Site, and our total aggregate liability arising from your use of the Site shall not exceed one hundred U.S. dollars ($100). This section applies to use of the Site only.

10. Indemnification

You agree to defend, indemnify, and hold harmless Calm Cove Hospitality LLC and its owners, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) brought by third parties arising from your violation of these Terms, your violation of law or the rights of others, or your use of the Site.

11. Governing Law; Class Action Waiver

These Terms are governed by the laws of the State of Florida. Any dispute arising from these Terms shall be brought exclusively in the state or federal courts located in Collier County, Florida. You and we agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

12. Changes to These Terms

We may update these Terms from time to time. The "Effective date" above shows when they were last revised. Continued use of the Site after changes constitutes acceptance.

13. General

If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent possible and the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our written consent; we may assign them without restriction. These Terms, together with the policies referenced in them, are the entire agreement between you and us regarding use of the Site.
